近几年,在全国很多地方,特别是一些大城市(如西安、银川、郑州、福州等)因出租汽车经营权诱发的上访、停运、堵塞交通、法律诉讼等公共事件不断,引起社会各界高度重视。为彻底搞清行业有关情况,笔者以西安市出租汽车经营权为切入点,对企业经营者、承包人、管理者进行了专题调查。透过出租汽车经营权,映射出行业内部的矛盾和利益冲突,也显示着行业管理部门太多的无奈。经营权配置问题的复杂性以及配置方式对行业发展极端的重要性,决定着政府制定公共政策应当遵循的基本原则和方法。公共政策的制定与实施关系到各方利益群体,涉及到管理部门、汽车制造商、企业、承包人、车主,集中体现政府在不同利益团体之间对社会公共利益进行的价值分配,最终达到博弈各方利益的均衡。政策制定和执行的过程也是公共利益界定和实现的过程,能否制定出科学的、反映各方面利益的、为社会所普遍认同的公共政策,是一切现代政府所面临的基本问题。本文按照“合作收益”、“博弈”理论框架,全面分析博弈各方的地位、作用,提出了“多方合作、共同经营、共同收益、经营特许、多方所有”的配置模式,并最终实现公司化、集约化经营的思路。|||In recent years, the disputes about the legal right to run taxi business frequently caused quite a lot of incidents in Xi’ an, Yinchuan, Zhengzhou, Fuzhou and some other big cities. These incidents like the localities appealing to a higher authority, business suspended, traffic blocks, or an appealing to a court, especially some incidents which caused deaths draw much attention from the people of various circles.In order to get a clear understanding of these incidents, the author focuses on Xi’ an’ s taxi business and makes a survey about taxi companies, taxi contractors and administrative personnel. The survey indicates that the administrative management of the right of taxi business exposes too many contradictions hardly solved and powerlessness of administrative management. It also shows the complication of the distribution of the right to run taxi business and the leading roles that the different ways of distributing the right play in taxi business. In Xi’ an , public policy making influences the interest of all different groups like taxi companies, car makers, enterprises, contractors and taxi drivers as well as administrative department. It basically shows how the government evaluates and distributes the social public interest and finally achieves the balance.
